2. Scope and related terms
2.1 These terms explain the conditions on which we make the Website available and permit use of its content. Please read them before using interactive features, downloading resources or creating an account. If you do not accept the applicable conditions, do not use those features or materials.
2.2 Browsing the Website does not create a paid subscription, authorise a payment or provide consent to marketing, research participation or cookies that require consent.
2.3 Purchases are governed by the specific offer and purchase terms made available before payment. Our Membership, Course & Presentation Terms cover Academy memberships and the individual products described there. Mentoring, certification, consultancy and separately ticketed events may have additional terms supplied before booking.
2.4 For a purchased product or service, its agreed purchase terms take priority over these general Website terms if they conflict. These terms do not reduce binding promises made at purchase or your mandatory legal rights.
2.5 Our Privacy Notice explains personal-data handling. It is an information notice, not a request for blanket consent. Any separate consent we need will be requested appropriately.
3. Educational information
3.1 Articles, videos, podcasts, practice examples and other free content provide general coach education and professional discussion. They are not an individual assessment of your players, coaching environment or circumstances.
3.2 We take reasonable care when preparing content. Research, professional guidance and our interpretations may develop over time. Publication dates and context matter, and an older article may not reflect later developments. Contact us if you identify a material error.
3.3 Coaching examples should be adapted to the players, facilities, equipment, supervision and safeguarding requirements in your setting. You remain responsible for appropriate risk assessment and professional judgement. Website content does not replace individual medical advice, safeguarding procedures or requirements imposed by your governing body or employer.
3.4 We do not guarantee particular player results, coaching outcomes, income, employment or accreditation from reading or applying Website content. This does not remove our responsibility for statements we make or commitments attached to a paid service.
4. Copyright and permitted use
4.1 Website text, videos, images, graphics, branding, recordings and resources belong to us or the relevant rights holders. Access does not transfer ownership. Third-party research and materials remain subject to their own rights and licences.
4.2 You may browse the Website, share links to publicly available pages, and print or download reasonable extracts for your own learning and coaching preparation, subject to any specific resource licence. Keep relevant attribution and copyright notices. You may apply general coaching ideas in your own practice, including paid coaching.
4.3 Unless a resource licence or applicable law permits it, you must not republish substantial parts of our content, resell or redistribute our resources, upload paid materials elsewhere, remove ownership notices, or reproduce our materials in your own commercial courses, publications or resource collections without permission.
4.4 You must not use our name, logo or branding in a way that falsely suggests a partnership, qualification, approval or endorsement. Ordinary references to our work and lawful criticism or quotation are not prohibited.
4.5 Do not scrape or copy our content in bulk to build competing libraries, commercial datasets or AI training collections without the necessary permission, except where applicable law permits the use. These terms do not prohibit lawful uses that cannot be restricted by contract.
4.6 Paid resources are also subject to their purchase licence. For permission requests, contact steve@mytenniscoaching.com .
5. Acceptable use
5.1 Use the Website lawfully and respect the rights, privacy and safety of others. You must not:
- Introduce malware, attempt unauthorised access, bypass security or deliberately disrupt the Website.
- Impersonate another person, submit fraudulent information or misuse another person’s account.
- Post unlawful threats, harassment, discriminatory abuse or material that unlawfully infringes another person’s rights.
- Publish confidential information or identifiable player information without the necessary authority.
- Harvest contact details or use Website facilities for unsolicited advertising or spam.
- Use automated requests in a way that overloads the Website, evades access restrictions or extracts restricted content.
5.2 Respectful disagreement, honest reviews, criticism and discussion of coaching ideas are permitted. We do not treat criticism alone as misuse.
5.3 Ordinary search-engine indexing of public pages is permitted where it follows our published crawler instructions, respects access controls and does not impair the service.
6. Accounts and restricted access
6.1 Where an account is required, provide accurate information, keep your login details secure and tell us promptly if you suspect unauthorised access. Do not share access to a paid account unless its licence expressly permits this.
6.2 Age and eligibility requirements for paid services are set out in their purchase terms. The Website is aimed primarily at adult coaches and coach developers. Do not submit children’s information through general contact forms when it is unnecessary.
6.3 We may proportionately restrict access to address a credible security threat, unlawful activity or material breach of these terms. Where appropriate, we will explain the reason and allow an opportunity to respond or correct the issue. Urgent protective action may be taken first where necessary.
6.4 A restriction affecting a paid membership or product will also be assessed under its purchase terms. These general terms do not give us an unrestricted right to remove paid access or keep payments for services we do not supply.
7. Comments and submissions
7.1 If the Website allows comments, reviews or other submissions, only submit material you are entitled to share. Your contribution must comply with section 5. Do not include unnecessary personal information, confidential records or identifiable footage of players without the required permissions.
7.2 You retain ownership of your original contribution. By intentionally posting it in a public discussion area, you permit us to host and display it there and make reasonable technical, accessibility or moderation edits needed to operate that feature. We will not alter its meaning or treat a public comment as blanket permission to use your identity or contribution in advertising.
7.3 Private enquiries remain private communications rather than public-posting permission. Promotional use of a private message, testimonial, photograph or recording requires separate permission where applicable.
7.4 We may remove or limit access to contributions that breach these terms, expose private information or present a credible legal or safety concern. Report concerns to our contact email. Lawful reporting to authorities or regulators is not restricted.
7.5 Academy practice submissions, coaching-lab recordings and member footage are governed by the more specific submission and safeguarding provisions in the Academy purchase terms and any permission obtained for the activity.
8. External links and platforms
8.1 The Website may link to or embed third-party services, research, videos, podcasts and resources. A link does not itself mean that we endorse every statement or service on the destination site. We do not control independent third-party pages and cannot guarantee their continuing availability or accuracy.
8.2 When you use another provider’s service, its applicable terms and privacy arrangements may also apply. Where WithMe delivers our Academy content or Stripe processes our direct payments, the relevant purchase terms explain those arrangements. Using an external provider does not remove our responsibilities for products or services we sell.
8.3 You may link fairly and lawfully to our public pages. Do not frame or present our Website in a way that conceals its source, misleads visitors or falsely suggests our endorsement.
9. Testimonials, endorsements and promotions
9.1 Testimonials used in our marketing must reflect genuine experiences and be used with the necessary permission. We may make minor edits for spelling, clarity or length, provided we preserve the person’s meaning and do not create a misleading impression.
9.2 Individual experiences do not guarantee that other customers will obtain the same results. Testimonials do not substitute for evidence supporting objective claims about our products or services.
9.3 Where a commercial connection, incentive, sponsorship or affiliate arrangement needs disclosure, we will identify it clearly alongside the relevant promotion. If we may earn commission from a link, that relationship will be made clear before you act on the recommendation.
9.4 References to publications, governing bodies, professional organisations or media appearances do not imply that they endorse every view we express or accredit our products. Any claimed accreditation or formal recognition must be expressly identified for the relevant product.
10. Privacy, cookies and security
10.1 Our Privacy Notice explains how we handle personal information and how to exercise your rights. Where cookies or similar technologies are used, we will provide the required information and obtain consent where the law requires it. Continuing to browse is not treated as consent where an affirmative choice is required.
10.2 Marketing choices are handled separately from acceptance of these terms. You can unsubscribe from marketing emails using the link provided or by contacting us. Essential messages about an existing purchase may still be sent where appropriate.
10.3 We take reasonable technical and organisational measures to protect information, but no internet service or email transmission is completely secure. Do not send full payment-card details, passwords or unnecessary sensitive player information by email or through general contact forms. Contact us to arrange an appropriate method where sensitive information genuinely needs to be shared.
10.4 This security guidance does not transfer our data-protection responsibilities to you or exclude liability for a failure to meet our legal obligations. If you identify a suspected security problem, report it privately without accessing, changing or disclosing other people’s information.
11. Website availability and changes
11.1 We may update, reorganise or remove free Website content and features. The Website may be temporarily unavailable for maintenance, technical faults or security work. We will take reasonable steps to minimise disruption and give notice of significant planned interruptions where practicable.
11.2 Changes to free Website features do not cancel or reduce a paid entitlement. Material changes affecting something you purchased are governed by its agreed purchase terms and applicable law.
11.3 We may revise these Website terms to reflect changes in the Website, relevant law or reasonable security requirements. We will identify the updated version and effective date and give appropriate notice of significant changes. Where a change requires your agreement, we will seek it; these terms do not make continued browsing automatic acceptance of any new paid obligation or reduction of an existing contractual right.
12. Our responsibility
12.1 We take reasonable care in operating the Website, but cannot promise that it will always be uninterrupted or free from every error. General educational material may not be suitable for every individual circumstance, as explained in section 3.
12.2 Where we owe you a contractual duty and breach it, we are responsible for loss that was reasonably foreseeable when the contract was made. We also remain responsible where the law imposes liability for negligence or another legal duty. These terms do not create a blanket exclusion of responsibility for Website errors, security failures or the work of our contractors.
12.3 Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation or any other liability that cannot lawfully be excluded or limited. Your mandatory consumer and data-protection rights remain unaffected.
12.4 Rights concerning paid digital content or services, including remedies where they are faulty, misdescribed or not supplied with reasonable care and skill, are not reduced by these general Website terms. No disclaimer here overrides a binding representation or promise made as part of a purchase.
13. Complaints and legal rights
13.1 For questions, complaints, permission requests or reports of misuse, email steve@mytenniscoaching.com . We aim to acknowledge complaints within two working days and provide a substantive response within 14 calendar days, or explain any delay and the next response date.
13.2 You are not required to use mediation before exercising your legal rights. Where applicable, we will provide required information about alternative dispute resolution and whether we are required or willing to participate.
13.3 These terms are governed by the law of England and Wales. Consumers retain mandatory protections of the country where they habitually live and any right to bring proceedings in their local courts. For disputes with users acting wholly in business, the courts of England and Wales have exclusive jurisdiction, subject to mandatory law.
13.4 If a provision is unlawful or unenforceable, the remaining provisions continue where they can reasonably do so. This does not authorise us to rewrite an unfair provision to your disadvantage. A delay in enforcing a right does not automatically waive it.
